"Humiliation... that is caused on account of arrest and detention of appellant and his family members and relatives in a false case does constitute mental cruelty to enable the husband to seek decree of divorce on this sole ground," said a division bench of Justices A P Deshpande and R P Sondurbaldota while granting divorce to a Pune resident. Dyanesh Soparkar and Lata (names changed) had an arranged marriage in March 2001 as per Hindu rites and they have a daughter. According to Soparkar, on the wedding night itself Lata called him blind for wearing spectacles and complained that she was given to understand that he earned a higher salary than what he actually got. The couple had frequent quarrels, according to Soparkar, over his wife's insistence that they stay separately. Dyanesh filed for divorce in June 2003 and a month later Lata filed a case for dowry harassment (Section 498 A of the IPC). She named Dyanesh, his mother and three other relatives. They were arrested and sent to custody. Two years later, a magistrate's court acquitted them, saying there was no evidence that Lata's family were coerced to pay Rs 50,000 as dowry. The family court dismissed Dyanesh's plea for divorce saying that a single complaint filed by the wife could constitute cruelty. Dyanesh moved the HC in appeal. His lawyers claimed that the arrest and detention of the family members and Dyanesh's near relations in a false case "has caused him agony". The HC agreed with Dyanesh's contention. A few days after she left him in May 2003, when he asked her to return, she lodged a criminal case against him, his parents and three close relatives.&lt;br /&gt;The husband sought divorce on grounds of cruelty at the hands of his wife, contending that her filing a false criminal case amounted to cruelty. The family court had dismissed the petition saying: “A singular complaint filed by the wife under section 498A of IPC against the husband and his family cannot indicate she is making false allegations.”&lt;br /&gt;The high court discarded the family court's opinion. “We fail to understand the logic behind the reasoning adopted by the family court,” observed the high court, adding: “It is illogical that more than one complaint needs to be filed to constitute mental cruelty.”&lt;br /&gt;In another case, the same bench dissolved the marriage of another Pune-based couple, which also involved the apparent misuse of section 498A, on the same ground. In this case, they were married in December 2000, and the husband's relatives were acquitted of the charge of cruelty to the wife.&lt;br /&gt;The wife did not stop at the complaint filed under 498A - she filed another complaint in a local court after the husband and his family were acquitted in the first case. The man, Selvam, got drunk and threw stones at an MTC bus in Vyasarpadi and waited for the police to arrest him.&lt;br /&gt;He told the police that he was unable to bear the torture of his wife and preferred jail to home. On Monday, he pleaded with the police not to send him back home and made sure that he was remanded for 15 days.&lt;br /&gt;Selvam, a casual labourer of Kakkanji Nagar, in Vyasarpadi, and his wife Govindammal (39), who have two children, argued often. Though initially Govindammal used to go away to her maternal home after the quarrel, she then got into the habit of beating him up. Sometimes she bashed him up for no reason at all, explained the police.&lt;br /&gt;After one such ‘bashing up’ early on Sunday morning, Selvam had a few rounds before going to the Sharma Nagar bus stop and threw two huge stones at an MTC bus going into the depot. The enraged driver drove to the local police station and lodged a complaint.&lt;br /&gt;After he was arrested, Selvam broke into tears during questioning. Men in our country don’t cry and certainly never get beaten,” says the engineer, who works for an MNC in Bangalore.     These are educated, well-settled and independent men. Says Kiran Bedi, former police commissioner, “These cases are not any different from what causes violence in men against women. For an aggressive woman, it’s determined by the environment she grows up in. She is an equal now. In the beginning, it may be a gradual slip. Or one she feels powerless to resist.”     Every Sunday in Bangalore, Mithun Kumar, another man “abused” by his wife physically and verbally, counsels battered men. “We get five to six men every week coming to us for help. Men are petrified someone will ask, ‘Did you provoke your wife by doing something wrong?’” says Kumar, an IT professional.     Adds Sarkar, “Men don’t hit back because they’re scared. Most are afraid the woman will call the police and the law will side with her.”     Is it the Bobbitisation of Indian society? We all remember the story of Lorena Bobbitt, who became known as the woman who cut off her husband’s penis with a carving knife. Says Uma Challa, president of All India Men’s Welfare Association in Hyderabad, “In our research, married men commit more suicides in India. We found that 65.35 per cent men end their lives, while only 34.65 per cent married women commit suicide.”     Tejinder Luthra, additional commissioner of police says, “We get allegations where the woman is the aggressor. The men are ashamed to talk about it.”     But what makes women the perpetrators of domestic violence? Today’s woman is fighting on so many fronts — at office, she has to be a know-it-all and as good as the guys if not better and fight twice as hard to prove it; while socialising, she has to be modern and with it and then with in-laws and family she has to meet the role of traditional bahu and homemaker. So, the pressure cooker is bound to burst... and it does!     Some nagging wives have problems in other relationships as well. Adds Kumar, “The children of these women don’t want to be with them as they live in dread of physical assault. But some women are only on a short fuse with their husbands.”     It’s a challenge to preconceived ideas of gender roles where it was virtually impossible for a woman to physically abuse a man. Says Suman Nalwa, ACP, Special Police Unit for Women: “The men who report abuse are few. When we get men who are booked under the Dowry Act, they plead that they’re being harassed by their wives.”     Men are confused. It’s put their identity in a crisis. Says Pinky Anand, lawyer: “As women grow financially, they want to control men. Recently, a wife slapped her husband at a party in a posh hotel in front of his friends.” The stories told by battered men are no less horrifying than those told by women. According to psychiatrist Dr Avdesh Sharma, “The tipping point comes when the women can’t be in control. Alcohol is making women aggressive. Some women remain tomboys.” It’s time men come out of the closet and get help. Simply say goodbye to shame and guilt! These men got hit too! As I was going through his words I had two feelings simultaneously i.e. sorrow and strength. His shocking experience of 25 days in jail, harassment by police &amp;amp; judiciary, a single man struggling to safeguard his family from the clutches of false FIR filed by his disgruntled bitter half and the resulting defamation almost brought tears in my eyes. At the same time it gave tremendous boost to the inborn strength within me to be a part of fight against misuse of gender biased laws. My decision to play an active role in SIF movement becomes firmer every day as I come across more &amp;amp; more victims of such senseless laws.&lt;br /&gt;Incidentally I read another article by a woman which dismisses subjects such as maternal mortality as “women’s issues” as it not only impacts the female of the species but the child, man, family and thus the entire society, making it everybody’s issue.&lt;br /&gt;Another article on the same day by one of our respected journalists said that India refuses to initiate any dialogues with Pakistan until cross-border terrorism is stopped. At the same time we all know that India is shelling huge amount of money everyday on the security of Jammu &amp;amp; Kashmir with the help of their well trained defence personnel.&lt;br /&gt;One article told us about a woman killing her husband with a grinding stone. Instead of emphasizing on the heinous act of wife, the media very smartly blamed the man saying he was drunk and picked up a fight with his wife. Such cold-blooded murders of husbands are suppressed by media instead of pointing out that cruelty &amp;amp; violence is not gender dependant and thus the senseless DV act must be gender neutral, not gender biased. NCRB has the statistics of crimes against women, but why not crimes against men by women? Nation is made of both the genders and not women alone, and as far as I know NCRB is National Crime Records Bureau, not specifically designed for women.&lt;br /&gt;Supreme Court has declared misuse of 498A as “Legal Terrorism” which forces 58,400 married men to commit suicide every year resulting in destruction of same number of families. As per NCRB survey 56,600 married men committed suicide in 2008 against 30,200 women same year. Which means total 86,800 humans died coz of marriage disputes &amp;amp; false cases by greedy wives resulting in agony of 1,73,600 families and unknown father / mother less children… and all this just coz of either misuse of 498A and/or marriage disputes. Is this not the biggest social issue??&lt;br /&gt;The government wants to fight external terrorism to pretend that they are safeguarding the country, but on the other side the entire system is encouraging &amp;amp; supporting deadlier “Legal Terrorism” under the shelter of 498A, thus proving their senselessness and frivolity. The feminist group wants to encourage &amp;amp; support this extortion racket and cover up the facts by talking about female foetuses, maternal mortality &amp;amp; alike, claiming the misuse of baseless &amp;amp; poorly framed gender biased laws as a part of “women empowerment”!? 7 out of 12 foetuses dumped in Ahmedabad were male whereas NDTV alleged that they were all females! Is the media working under the pressure of feminist group? If yes, they need to rename their channels and make them women specific.&lt;br /&gt;Harassment of husbands and their family by the addle-brained wives, police &amp;amp; judiciary is not only a men’s issue but it’s a social issue as it affects the entire family &amp;amp; society, just like maternal mortality. Eliminating “Legal Terrorism” is the duty &amp;amp; responsibility of the government just like fighting against external terrorism; and it is our right to wake up the government &amp;amp; sleeping men, and to warn the drooling ones dying to be victimized. It is the responsibility of media to provide true &amp;amp; current news without doing injustice under the pressure of politicians and/or a bunch of feminists.&lt;br /&gt;Every victim of 498A and other similar gender biased laws will incur sin if he fails to show hell to his bitter half right on this planet by pelting her with counter cases. There is no mercy and no forgiveness for the misuse of 498A. Any such resemblance whatsoever is purely co-incidental.&lt;br /&gt;Jigar is the only child of his parents, brought up in a typical Indian household wherein the father is the breadwinner and the mother the homemaker. As a child, he spent more time with his mother and got attached with her more than his father. Often, his father’s friends would come at their place to play cards. Sometimes even Jigar used to be with them and he would see his father being bullied by his friends as “Joru ka Gulaam (Wife’s slave)”.&lt;br /&gt;Young Jigar’s budding personality and psyche had a deep impact from these words. Because, though they were jokes cracked by his father’s friend, Jigar would see his father’s embarrassed face – as if caught, “Red-handed”. It created a story in his mind that being labeled, “Joru ka Gulam” is a bad thing and very demeaning and unbecoming of a man.&lt;br /&gt;He was confused. On one hand, he loved his mother so much and on the other hand, there was his father, devastated for listening to his wife – the same woman.&lt;br /&gt;As he grew up and went to college, he got a girlfriend. As he opened up with her and told her about his mother, her first reaction was, “Oh, you are mama’s boy!”&lt;br /&gt;The statement hit Jigar like a thunder in a lightening. For the first time in his life, he came to know that his love for his mother is not acceptable to the other woman in his life – his girlfriend.&lt;br /&gt;Jigar’s story is not a one-off. This is a tale-de-life for many a men in the today’s society.&lt;br /&gt;And just then, he came across this article by Shalini Sengupta titled, “&lt;a href="http://timesofindia.indiatimes.com/home/sunday-toi/view-from-venus/A-man-should-talk-to-mum-but-listen-to-his-wife/articleshow/5826761.cms" target="_blank" included="null"&gt;A man should talk to mum but listen to his wife&lt;/a&gt;” which not only questions but also subdues the love of a mother and a son and calls it interference in a son’s married life but at the same time the author is silent on the interference of the daughter’s (read wife’s) mother in her marriage – passed off as mother’s love for a daughter.&lt;br /&gt;Is a mother-daughter love valid but not a mother-son love? Why this bias against men?&lt;br /&gt;Feminists have always designed “Weapons of Male Destruction (WMD)” either by ways of anti-male and unconstitutional laws or through such attitudes like, “Joru ka type='text'>Govt to look into misuse of dowry laws</title><content type='html'>Following complaints about the misuse of dowry laws by women, the Centre has decided to look into the issue and will hold a consultation programme to get views and suggestions from NGOs and activists working for men.&lt;br /&gt;Acting on complaints about the misuse of dowry laws, the Union Ministry for Women and Child Development would organise a consultation programme where men from different walks of life would be invited to express themselves on June 25.&lt;br /&gt;"The ministry has received complaints from men about the urgent need to amend Section 498(A) of the dowry law claiming that many women misuse the law to their benefit. After the consultation, the Ministry will examine how far this claim is right before deciding on any thing," Union Minister for Women and Child Development Renuka Chowdhary said.&lt;br /&gt;The Ministry has put out advertisements asking people to write to them about such grievances. The government has received many suggestions and case studies through its website that invited affected persons to share their woes and offer suggestions to check the misuse of such laws.&lt;br /&gt;"The consultation is a platform to provide them an opportunity to express their concerns about the legal provisions in Section 498 A. In a suicide note, addressed to the Allahabad High Court, Singh alleges that he was framed in a dowry case by his wife Vinita and her relatives, due to which he had to spend time in judicial custody for four months.&lt;br /&gt;The Vikas Nagar police registered a case later in the day.&lt;br /&gt;“During the investigation, if we find it necessary to question Vinita, we will definitely record her statement,” said BP Singh, Station Officer, Vikas Nagar.&lt;br /&gt;Pleading innocence and holding his wife responsible for the extreme step he was taking, Singh’s note states: “I was sent to jail after a false dowry case was lodged against me by Vinita and her family, who had demanded Rs 14 lakh as a compensation. Neither my father nor I had seen such a big amount in our lives. We even sold our house to contest the case.”&lt;br /&gt;According to reports, Singh married Vinita about two years ago and lived in Allahabad since.&lt;br /&gt;Early last year, his wife left him and started living with her family.&lt;br /&gt;A case under Sections 323 (voluntarily causing hurt), 498 (A) (cruelty by husband or relatives of husband) and 504 (intentional insult) was lodged by Vinita and her relatives before she left him.&lt;br /&gt;In the note, Singh wrote he was in the Naini Central Jail from “September 29 to December 24, 2007”.&lt;br /&gt;Shishupal Singh, Singh's brother-in-law, said he was disturbed ever since he released from jail. The court case constantly haunted him.&lt;br /&gt;“After he was bailed out, he was living with his mother, younger sister and a physically-challenged brother in a rented house in Jankipuram.” The family had their own house in Indira Nagar, which was recently sold to meet the legal expenses, he added.&lt;br /&gt;“While he searched for a job, he drove a three-wheeler for a living. A few days ago, he received a notice from the court and since then, he stopped stepping out of the house,” he said.&lt;br /&gt;In the note, Singh further wrote: “I would also like to request Vinita not to harass my family in future. She took all my friend's e-mail ids and phone numbers. She never revealed her friends phone numbers or e-mail ids. Now she is waiting for me in India to put up a case against me. Thank god i suspect something when she was with me and recorded some of her conversations with her parents.&lt;br /&gt;&lt;br /&gt;Is it crime to get married as per Hindu Law????
